Research

The advice and the practice pages rest on judgments read in full, with the citations followed to the latest decision.

The research wing

The chambers runs a research wing that reads Supreme Court judgments in full and records what each one decides, the provisions it applies and the cases it follows or distinguishes. The work is used in the case notes on this site and in the advice given to clients.

How the research is done

Reading the judgment, not the summary

A headnote can lose the qualification that decides the next case. We work from the text of the judgment, including the paragraphs that distinguish earlier decisions and the operative order at the end.

Tracing how a doctrine moved

A rule stated in one case is often narrowed in another and overruled in a third. We follow the citations forward so that a proposition is not quoted from a judgment that no longer holds.

Checking the statute in force

Penal and procedural provisions changed with the Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam. Research checks the section that applied on the date of the offence and the section that applies now.

Who it is for

Advocates and litigants

The case notes on the practice pages carry the citation, what the court held and how the point is used in practice.

Academics and students

The full-text reading and cross-references give a starting point for work that needs more than a headnote.

Businesses and compliance teams

A line of authority that changes what a business must do is followed to the latest decision before it is relied on in advice.
